ASSUMPTION OF RISK. RELEASE OF LIABILITY. INDEMNIFICATION.
The participant would like to participate in one or more leagues, clinics, practices, games, tournaments, camps, programs and/or other activities that are sponsored by, hosted by, operated by, arranged by, or otherwise involving All American Athletics, LLC or that take place at facilities owned, leased or operated by All American Athletics, LLC (the “Activities”). The participant and the participant’s parent or guardian, on behalf of the participant, if the participant is under 18 years old or does not have the legal capacity to bind himself or herself to contracts (hereafter, the “Participant’s Parent or Guardian, if applicable”) acknowledge that (1) the Activities involve risks, including the risk of injury or death from any cause both on and off the field of play and the risk of damage, loss or theft of property and (2) the participant (and the Participant’s Parent or Guardian, if applicable) are not relying on All American Athletics, LLC or any of their respective affiliated entities, members, managers, officers, employees, agents, representatives and contractors to referee or control the Activities. Nevertheless, the participant would like to participate in the Activities, and the participant (and the Participant’s Parent or Guardian, if applicable) hereby assume all risks related to the Activities, all risks related to the equipment used in connection with the Activities (even if All American Athletics, LLC has recommended or provided such equipment), and all risks related to the participant’s presence at, in or near the facilities at which the Activities take place, including parking lots (and other outside areas), rest rooms, locker rooms, fields of play, warm-up areas, practice areas, concession areas, common areas, bleachers, retail areas, and all related areas (the “Facilities”). Further, the participant (and the Participant’s Parent or Guardian, if applicable) release and indemnify All American Athletics, LLC and their respective affiliated entities, members, managers, officers, employees, agents, representatives and contractors from all liability (including all liability for any injury, death, or property loss or damage) resulting from or related to the Activities, the equipment used in connection with the Activities (even if All American Athletics, LLC has recommended or provided such equipment), the condition of the Facilities, and/or the participant’s presence at, in or near the Facilities.
Assumption of the Risk and Waiver of Liability Relating to Coronavirus/COVID-19
The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. As a result, federal, state, and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people. All American Athletics, LLC (“AAL”) has put in place preventative measures to reduce the spread of COVID-19; however, the AAL cannot guarantee that you or your child(ren) will not become infected with COVID-19. Further, attending AAL activities could increase your risk and your child(ren)’s risk of contracting COVID-19.
By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that my child(ren) and I may be exposed to or infected by COVID-19 by attending the AAL and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 at AAL may result from the actions, omissions, or negligence of myself and others, including, but not limited to, AAL employees, subcontractors, and program participants and their families. I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to my child(ren) or myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I or my child(ren) may experience or incur in connection with my child(ren)’s attendance at AAL or participation in AAL programming (“Claims”). On my behalf, and on behalf of my children, I hereby release, covenant not to sue, discharge, and hold harmless the AAL, its employees, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of the AAL, its employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in any AAL program.
The participant (and the Participant’s Parent or Guardian, if applicable) acknowledge that All American Athletics, LLC or USA (or someone with the permission of All American Athletics, LLC or USA) may take photographs or videos of the participant while engaged in the Activities or while at the Facilities for use in All American Athletics, LLC’s or USA’s advertising or marketing efforts or other materials promoting All American Athletics, LLC or USA and the participant (and the Participant’s Parent or Guardian, if applicable) grant All American Athletics, LLC and USA permission to use all such photographs or videos for those purposes and waive any right to payment or other remuneration in connection with such use. I have read, understand, and agree to the policies and procedures for All American Lacrosse programs.
